A person who occupies or uses any state land as a right-of-way for a telephone, telegraph, electric transmission or power line, for an oil pipeline, gas pipeline or sulfur pipeline or for an irrigation canal, lateral, water pipeline, road and any other purpose the commissioner considers in the best interest of the state shall pay annually in advance an amount equal to 2.5 cents a linear rod for each rod of telephone, telegraph, electric transmission or power line or for each rod of oil or gas pipeline or an amount set by the commissioner for roads and other easements.
The Department of Criminal Justice Board may grant or lease permanent or temporary right-of-way easements on department land for public highways, roads, streets, ditches, electric lines and pipelines used to distribute water, electricity, gas, oil or similar substances, electrical substances or provision of utilities. Easements may be granted or leased for fair and adequate consideration.
