Description

These receipts originate from a settlement prior to a court decision or court decision holding in favor of the state and are for the amount agreed in the settlement or the principal amount of the award.

Funds recovered in litigation or a settlement, including funds designated as damages, amounts adjudged or awarded, attorney's fees, costs, interest, settlement proceeds, or expenses, are deposited in the state treasury to the credit of the appropriate fund or account.

The attorney general may certify to the comptroller and the Legislative Budget Board that money awarded to the state in settlement of a claim is money to be credited to the account for a particular appropriation if it is not clear under applicable law to which account the money should be credited.

20% of amounts received in a court action brought by the Attorney General for racketeering related to human trafficking are paid (on a pro rata basis) to local law enforcement and district attorneys assisting in the suit. The first $10 million of the remaining 80% is deposited to GR Account 0469 - Compensation to Victims of Crime.
