Created in 2003 by H.B. 730, 78th Leg., R.S. in Property Code §§ 408.002, 417.003, 419.001, 419.003, 426.003, 427.001, 430.008, 437.002. A builder shall register a new home with the commission where there is a dispute between the builder and the homeowner. The registration must include information required by the commission by rule, be accompanied by a $125 fee and delivered by the appropriate date. Penalties up to $10,000 may be assessed against a builder who fails to pay a required registration fee. A violation of § 418.001 (2) or (12) is punishable by a penalty up to $100,000. Fees will also be charged for registering arbitrators (up to $100 for certification and $50 for renewal) and late fee, third-party inspectors, third-party warrant companies and to cover the expenses of inspecting and administering energy and emission programs, arbitration and alternative dispute resolution when applicable. Amended by H.B. 1038, 80th Leg., R.S. This section expired 9-1-10 due to sunset of Texas Residential Construction Commission, Agency 370 and the related statute.
