Purpose

Established to receive Clean Air Act fees used to safeguard air resources of the state, including payments to Public Safety Commission for cost of administering vehicle emissions inspection/maintenance program, except that after the date of delegation of the state's permitting program under Title V, Federal Clean Air Act, fees may be appropriated only to cover costs of developing/administering the federal permit program under Titles IV and V of Federal Clean Air Act.

In addition to funding local incentive projects, fees collected under § 382.202(c) and § 382.302, up to $7 million per year, may be used for counties participating in Low-Income Vehicle Repair Assistance, Retrofit, and Accelerated Vehicle Retirement Programs under § 382.209 only on a matching basis. $2 million of the $7 million may be used only for projects to reduce the use of counterfeit inspection stickers.

The Emissions Reduction Incentive Account was created as a subaccount within 0151 from gifts, grants and other sources by H.B. 638, 78th Leg., R.S.

$500,000 is transferred annually to this account from Fund 1201 – Texas Emissions Reduction Plan Trust.
