Purpose

Established to receive Clean Air Act fees used to safeguard air resources of the state, including payments to Public Safety Commission for cost of administering vehicle emissions inspection/maintenance program, except that after the date of delegation of the state's permitting program under Title V, Federal Clean Air Act, fees may be appropriated only to cover costs of developing/administering the federal permit program under Titles IV and V of Federal Clean Air Act.

In addition to funding local incentive projects, fees collected under § 382.202(c) and § 382.302 may be used, NTE $5 million per year, for counties participating in LIRAP programs under § 382.209 only on a matching basis.

The Emissions Reduction Incentive Account was created as a subaccount within 0151 from gifts, grants and other sources by H.B. 638, 78th Leg., R.S. It retains its own interest and is used for incentive projects as approved by the Legislature.
