GR Account 0151 – GR Account - Clean Air

Established to receive Clean Air Act fees used to safeguard air resources of the state, including payments to Public Safety Commission for cost of administering vehicle emissions inspection/maintenance program, except that after the date of delegation of the state's permitting program under Title V, Federal Clean Air Act, fees may be appropriated only to cover costs of developing/administering the federal permit program under Titles IV and V of Federal Clean Air Act.

In addition to funding local incentive projects, fees collected under § 382.202(c) and § 382.302, NTE $7 million per year, may be used for counties participating in Low-Income Vehicle Repair Assistance, Retrofit, and Accelerated Vehicle Retirement Programs under § 382.209 only on a matching basis. $2 million of the NTE $7 million may be used only for projects to reduce the use of counterfeit inspection stickers.

The Emissions Reduction Incentive Account was created as a subaccount within 0151 from gifts, grants and other sources by H.B. 638, 78th Leg., R.S.

Unobligated balances previously transferred to GR at the end of each biennium.

Requirement deleted by H.B. 2049, 73rd Leg., R.S. eff. 9-1-93.

Exempt from loss of dedication (§ 403.094, Government Code) by Acts 1993, 73rd Leg., ch. 685 § 2.01 and ch. 746, § 9.

A subaccount, NTE $20 million, was added by H.B. 1611, 79th Leg., R.S. and was repealed by S.B. 12, 80th Leg., R.S.

H.B. 2859, 83rd Leg., R.S. increased use of fees under §382.209 from NTE $5 million to NTE $7 million and added that $2 million may only be used for counterfeit inspection stickers.

H.B. 7, 83rd Leg., R.S. requires interest be deposited to General Revenue (0001).
