Purpose
Used for payment of compensation to claimants under and other expenses in administering the Act. Court costs collected under the Act and juror donations made under § 61.003, Government Code are the source of funding. If funds deposited in a fiscal year are in excess of compensation payments during that year, attorney general may retain a portion as an emergency reserve for the next fiscal year, NTE $10 million.
Receives court costs from defendants convicted under certain sections of the Penal Code. Defendants convicted of a felony pay $133, defendants convicted of a Class A or B misdemeanor pay $83 and defendants convicted of a nonjailable misdemeanor pay $40. This account receives 37.6338% of total collections.
1) Money may also be appropriated to assist state agencies that deliver or fund victim-related services or assistance. (Applies only to appropriations made for the 2000/2001 biennium.)
2) May also be used for support for private Texas non-profit corporations providing direct victim-related civil legal services.
3) May also be used to reimburse a law enforcement agency for reasonable costs of a medical exam preformed by a physician, sexual assault examiner or sexual assault nurse examiner.
4) Court may order convicted defendant to pay restitution to the account to the extent the account has paid compensation to or on behalf of the victim.
5) Receives 50% of the proceeds from the disposal of eligible exhibits as surplus or salvage property by the Commissioners Court.
6) Receives first $10 million, then 50% of all pay telephone commissions received by TDCJ, Agency 696.
7) May receive NMT 50% of the excess balance that exceeds $5 million in GR Account -- Compensation to Victims of Crime Auxiliary at the end of each fiscal year.
