GR Account 0540 – Judicial and Court Personnel Training

To receive court costs on conviction of certain sections of the Penal Code. Defendants convicted of a felony pay $185, defendants convicted of a Class A or B misdemeanor pay $147 and defendants convicted of a nonjailable misdemeanor pay $62. This account receives 3.3224% of the total collections. 

Receives a portion of the $137, $45, and $21 consolidated civil filing fees under Local Government Code sec. 133.151. 

Government Code 56.002 requires 50% of fees collected by clerks of the courts of appeals under Government Code sec. 51.207 be deposited to this account.

Funds are to be used to provide for the continuing legal education of judges and of court personnel. May also be used to provide innocence training programs for law enforcement officers, law students and other participants.

Use of funds expanded by S.B. 496, 80th Leg., R.S.

Originally created as a special fund outside of General Revenue and recreated as a GR Account by S.B. 1, 82nd Leg., 1st C.S. Unexpended balance in excess of $500,000 transferred to General Revenue Fund (0001) at the end of each year. This provision was removed when recreated as a General Revenue Account. 

Effective 01/01/2020, S.B. 346, 86th Leg., R.S. increased court costs for felonies from $133 to $185, Class A or B misdemeanor from $83 to $147 and nonjailable misdemeanors from $40 to $62. S.B. 346 changed percentage from 4.8362% to 3.3224%.

S.B. 41, 87th Leg., R.S. added the consolidated state civil fees.
