Purpose

Receives a portion of the $137, $45, and $21 consolidated civil filing fees under Local Government Code 133.151 (Revenue Code 3711). Revenue from these fees is divided between the Basic Civil Legal Services subaccount and for the purpose of supporting the judicial branch.

Defendants convicted of a felony pay $185, defendants convicted of a Class A or B misdemeanor pay $147 and defendants convicted of a nonjailable misdemeanor pay $62. This account receives 12.2667% of total collections (Local Gov. Code 133.102). (Revenue Code 3704)

Receives the net amount of a civil penalty that is recovered in an action by the attorney general in any matter actionable under the Business & Commerce Code, unless authorized by other law (Gov. Code 402.007). 

Receives 50% of settlements and penalties collected by district or county attorneys for civil liability cases involving the  sale or production of synthetic controlled substances. Revenue deposited to the Basic Civil Legal Services subaccount (Bus. & Comm. Code 17.463).

Judicial fees collected by the Supreme Court and Courts of Appeal are deposited to the Supreme Court support account in the Judicial Fund and used for court-related purposes. The fee is not to exceed $50 (Gov. Code 51.0051).

No more than $50 million per year may be credited to the fund for providing basic civil legal services to the indigent.

Receives money in abandoned Interest on Lawyers’ Trust Account (IOLTA) and unclaimed money in a client trust account held with a law firm. Deposited to Basic Civil Legal Services subaccount under Property Code, sec. 74.604.

S.B. 41, 87th Leg., R.S. abolished the previous filing fee structure under Local Government Code 133.151 and added the consolidated state civil fees listed in the description above.
