Created on September 1, 1997 by H.B. 2272, 75th Leg., R.S. in TEX. LOC. GOV'T CODE ANN. § 133.102 to receive court costs from defendants convicted under certain sections of the Penal Code. Defendants convicted of a felony pay $133, defendants convicted of a Class A or B misdemeanor pay $83 and defendants convicted of a nonjailable offense pay $40. This account receives 12.0904% of total collections. Used to fund the sex offender compliance unit at DPS. Administered by the Texas Department of Public Safety, Agency 405 and Texas Department of Criminal Justice, Agency 696. Creation of the account was finally authorized by H.B. 2948, 75th Leg., R.S. Amended by S.B. 565, 76th Leg., R.S. The creating language in § 411.0097, Government Code, authorized use of the account by the Department of Public Safety (DPS), Agency 405 and the Texas Department of Criminal Justice (TDCJ), Agency 696 and expired under its own terms, effective 9-1-99. Account was continued under § 102.019(h), Code of Criminal Procedure which was repealed by H.B. 2424, 78th Leg., R.S., effective 10-1-03. The account was continued by reference in § 102.075, Code of Criminal Procedure, which was recodified at § 133.102, Local Government Code by H.B. 2424. Statutory use of the money in § 411.0091, Government Code, authorizing DPS to fund a sex offender compliance unit is no longer valid. Reference to the account in § 133.102 was deleted in H.B. 442, 82nd Leg., R.S. Balance in the fund was transferred to the General Revenue Fund (0001) under the dormant fund or account provision in § 403.0915, Government Code in January 2011.
