Revenue Object 3704 – Court Costs – DNA Testing

Court costs are paid related to DNA testing:

1. $250 on conviction of certain offenses, including kidnapping, sexual assault, burglary and public indecency;
2. $50 on conviction of ceratin misdemeanors and felonies;
3. $34 on placement of a person on community supervision, including deferred community supervision, if DNA sample is required;
4. $50 if a delinquent child is committed to the Texas Juvenile Justice Department, $34 if the child is not committed.

Upon conviction at the same time as other court costs.

Deposited by Comptroller when received from custodian of municipality or county treasury, required to remit not later than last day of the month following each calendar quarter.

Municipality or county may retain 10% as a service fee.

Administered by Governor - Fiscal, Agency 300 and the Texas Department of Transportation, Agency 601.

Amended by S.B. 1180, 78th Leg., R.S.

S.B.727, 81st Leg., R.S. attempted to dedicate community supervision and delinquent child costs (items 3 and 4) to the Department of Public Safety, Agency 405, however, the dedication was not exempted in H.B. 4583, 81st Leg., R.S., funds consolidation bill. Therefore these funds are deposited to unappropriated General Revenue.
