Revenue Object 3557 – Health Care Facilities Fees – Convalescent and Nursing Facilities

To record:

(1) Initial, renewal and change of ownership license fees not to exceed $375 per facility plus $15 for each unit of capacity or bed space. (242.034)

(2) Probationary license fees not to exceed $125 per facility plus $5 for each unit of capacity or bed space. (242.034)

(3) Background examination fees in an amount necessary to defray the commission's expenses for background examinations. (242.034)

(4) Administrative fee of $20 when an institution hires a new administrator or chief manager. (242.010)

(5) Fee set by executive commissioner by rule for early compliance review of building plans to construct or modify an institution. (242.0385)

(6) Fee set by executive commissioner by rule for certification that an institution provides special care and treatment of persons with Alzheimer's and related disorders. (242.040)

(7) An additional annual license fee charged if the amount deposited to Nursing and Convalescent Home Trust Fund (No. 0992) is less than $10 million. Fee is set at $1 for each licensed unit of capacity or in an amount needed to provide $10 million in fund. Total fees assessed in a year may not exceed $20 for each licensed unit of capacity or bed space in a facility. (242.097)

(8) Fee charged for expedited life safety code and physical plant inspection as set by executive commissioner by rule. Fees charged may be different based on the size and type of institution.(242.039)

(9) Provisional license fee for an applicant currently licensed in another jurisdiction who seeks a license in Texas set by the board in an amount to cover the cost of issuing the license. (242.309)

(10) License renewal fee expired 90 days or less is 1 1/2 times normal renewal fee. License renewal fee expired over 90 days but less than 1 year is 2 times normal renewal fee. A license expired for one year may not be renewed and the person must reapply. (242.315)

(11) A fee equal to two times the normally required renewal fee for a person who was licensed in this state, moved to another state, and is currently licensed and has been in practice in the other state for the two years preceding the date of application. (242.315)

(12) Administrative penalties not to exceed $10,000 per day for each violation except violations of section 242.072(c) are not to exceed $1,000 per day. (242.066) Administrative penalties imposed as sanctions are not to exceed $1,000 per day. (242.315) (Collected under Revenue Object 3770)
