Description

Persons convicted of certain offenses under the Penal Code shall pay, in addition to all other costs, court costs for special services as follows:

  • A defendant convicted of a felony -- $185.
  • A defendant convicted of a class A or B misdemeanor -- $147.
  • Conviction of a nonjailable misdemeanor -- $62.

GR Account -- Specialty Court receives 1.0377% of total fees collected.

Due Date

Upon conviction at the same time as other court costs.

Deposited by Comptroller when received from custodian of the county treasury who is required to remit not later than the last day of the first month following each calendar quarter.

County may retain 10% of collections as a service fee and an additional 50% if the county has established an authorized drug court program.

The drug court account in GR was not exempted in H.B. 3107, 80th Leg., R.S. and was not created.

Deposit changed from General Revenue Fund 0001 by H.B. 3391, 85th Leg., R.S. GR Account 5174 was created by exemption in funds consolidation bill H.B. 3849, 85th Leg., R.S.

Effective 01/01/2020, S.B. 346, 86th Leg., R.S.  repealed the $60 cost on conviction of offense as a Class B Misdemeanor or higher and added percentage of court costs under Local Government Code sec. 133.102. $60 court cost previously deposited to GR Account 5174 Drug Court. S.B. 346 redesignated GR Account 5174 Drug Court as the GR Account 5184 Specialty Court. Revenue object subtitle renamed from "Intoxication and Drug Convictions" to "Specialty Courts" to reflect new purpose.
