Revenue Object 3400 – Business Fees – Agriculture – Hemp

The department collects fees for the following fees for hemp growers:

• An application fee for an initial license up to $100.
• A license renewal fee up to $100.
• A participation fee for each location where hemp is cultivated or handled up to $100.
• A site modification fee for each change to location up to $500.
• A collection and testing fee for each preharvest test or postharvest test performed by the department up to $300.

The department shall register independent testing labs and create a registry. The department may charge a registration fee to cover administration costs.

Violations of regulations regarding hemp transport are punishable by a civil penalty of up to $500 per violation. Coolected under Revenue Code 3717 by the Department of Public Safety and deposited to General Revenue Fund 0001 (Agriculture Code sec. 122.356).

The deposit of the civil penalty to the Hemp Transportation Account per H.B. 1325 was not exempted in the funds consolidation bill, H.B. 3317, 86th Leg., R.S. The account was not created and the penalty was redirected to General Revenue Fund 0001.
