Description

In addition to other state traffic fines:

  1. A person convicted of a traffic offense or who pleads guilty or no lo contendere shall pay a $50 state traffic fine.
  2. A person convicted of driving while intoxicated under Penal Code 49.09 shall pay a traffic fine. Four percent may be retained by the local entity for administration and the remainer remitted to the state. Of the amount remitted, 80% is deposited to GR Fund 0001 and 20% to GR Account 5111.
  3. In addition to reimbursement fees imposed by art.102.018, a $100 fine shall be paid on conviction of an intoxication offense.
  4. A defendant convicted of a misdemeanor drug offense under the Controlled Substances Act, whose driver's license is not suspended, must pay a fine of $100.

H.B. 2048, 86th Leg., R.S. increased the state traffic fine from $30 to $50 and changed the allocation from 67% to GR and 33% to GR Account 5111 to 70% and 30% respectively. H.B. 2048 added the DWI traffic fine.

Effective 01/01/2020, S.B. 346, 86th Leg., R.S. changed item 3 from a fee to a fine. Therefore, collection of this revenue was moved from revenue object 3704.
