Description

Two fees are charged under Local Government Code sec. 133.151 for filing the following in district court, statutory county court, statutory probate court, or county court:

  1. $137 for filing any civil, probate, guardianship, or mental health case, and
  2. $45 on any other action.

Section 133.151 also includes a $21 fee for filing a civil case and any other action in a justice court.

Of these fees, the Basic Civil Legal Services subaccount in the Judicial Fund (0573) receives:

  • 14.5985% of the $137 fee,
  • 22.2222% of the $45 fee, and
  • 28.5714% of the $21 fee.

In addition to other fees, clerks of the supreme court and courts of appeal shall collect a $25 fee on filing of civil action or proceeding requiring a filing fee (sec. 51.941).

Due Date

At the time of filing. Deposited by Comptroller when received from custodian of municipal or county treasury, required to remit not later than last day of month following each calendar quarter.

S.B. 41, 87th Leg., R.S. repealed the district court filing fees of $5 and $10 (133.152). Also repealed the $10 county court fee and $6 justice of the peace courts fee (133.153).

S.B. 41 abolished the $45 filing fee for divorce and family law cases and the $50 filing fee for other cases under 133.151 and added the consolidated state civil fees listed in the description above.
