Revenue Object 3595 – Medical Assistance Cost Recovery – Health and Human Services Commission

To record recoveries related to claims paid for various Medicaid services.

The commission is required by federal regulation and state law to pursue payment from any individual, entity or program that is liable to pay the expenditures for medical assistance furnished under a state plan. This includes a Medicaid client's private insurance as well as tort liability claims, trusts and annuities.

The filing of an application for, or receipt of, medical assistance constitutes an assignment of the applicant's or recipient's right to recover from:  (1) personal insurance;  (2) other sources; or  (3) another person for personal injury caused by the other person's negligence or wrongdoing. 

Each policy delivered must provide for the repayment of the actual cost of medical expenses paid by this state through medical assistance for an insured person if, under the policy, the insured person is entitled to payment for the medical expenses.

Previously deposited to the Welfare Assistance Operating Fund Account (0167), abolished August 31, 1995 per § 403.095, Government Code. Prior to that, to Medical Assistance Fund (0149).

Transferred from Department of Aging and Disability Services (539) to the Health and Human Services Commission (529) by S.B. 219, 84th Leg., R.S.

S.B. 200, 84th Leg., R.S. transferred end stage renal disease, epilepsy and hemophilia programs from Department of State Health Services (537) to the Health and Human Services Commission (529) under Government Code secs. 531.0201 and 531.02011.
