Description

The board by rule shall establish fees for issue or renewal of souvenir or specialty plates marketed by a private vendor in amounts reasonable to recover cost of contracting.  The state's fee may not be less than $40 for each year issued. 

From each fee the department deducts $8 for administrative costs. 

The disposition of the remaining amount of the fee can be one of the following:

  • Deposited to the License Plate Trust Fund (0802), if the sponsor nominated a state agency to receive the funds.
  • Deposited to General Revenue, if there is no sponsor.
  • For plates issued under Transp. Code 504.614, the public entity that provides funds for the professional sports team's facility.
  • To pay to the private vendor the remainder of the fee.

Prior to H.B. 2202, 83rd Leg., R.S., the $8 was deposited to the State Highway Fund 0006. H.B. 2202 re-allocated that amount to the new Department of Motor Vehicles Fund, which was not created per funds consolidation (H.B. 6). Therefore the $8 is deposited to General Revenue 0001.

S.B. 1512, 84th Leg., R.S. recreated the Texas Department of Motor Vehicles Fund and it was exempted by H.B. 6, 84th Leg., R.S. Deposit of $8 changed from General Revenue to Texas Department of Motor Vehicles Fund (0010). Effective 9/1/16.
