Description

Annual examination assessment is made on each domestic insurance company based on company's annual premium receipts, admitted assets, and/or insurance in force. Amount of assessment paid in each taxable year allowed as credit (see note below) on amount of premium taxes (Revenue Code 3201) paid by company in that year, except no credit is given for fees incurred by a domestic insurance company for fees arising from exam/audit of books in offices outside Texas.

S.B. 1, 82nd Leg., 1st C.S. removed the premium tax credit on assessment payments for calendar years 2012 and 2013. This provision expires 01/01/2014.

The Financial Examination Division and Actuarial Division become self-directed, effective September 1, 2011. The financial program continued within the department through a one year transition period. On September 1, 2012 on finding of fact by the Comptroller, money related to self-directed funding was transferred from GR Account -- Department of Insurance Operating (0036) to the Texas Treasury Safekeeping Trust Company per S.B. 1291, 82nd Leg., R.S.
