The executive commissioner shall establish a program for certification of a person involved in a lead-based paint activity and for accreditation of training providers in compliance with federal laws and rules. The commissioner may assess a fee to recover costs administration and enforcement.
In addition to civil and criminal penalties, the department may assess administrative penalties of not more than $5,000 for each day of a violation of the act (collected under revenue object 3770). May assess civil penalties up to $2,000 for the first violation and $10,000 for subsequent violations (collected under revenue object 3717).
Every two years. The commissioner may adopt a staggered renewal system.
