Leases issued for unsold surveyed or unsurveyed school land must include a provision requiring payment of damages for use of the surface in prospecting for, exploring, developing or producing the leased minerals. This does not apply to land included in islands, saltwater lakes, bays, inlets, marshes and reefs owned by Texas in tidewater limits and the Texas portion of the Gulf of Mexico.
The Land Commissioner sets the amount and collects the money for damages to surface of land dedicated to the permanent school fund.

For conservation, reclamation or permanent improvements on Permanent School Fund lands.
