The department may certify each person who produces, processes, distributes or handles an organic agricultural product in this state. Person may apply for any required certification by submitting an application, a production plan and a fee. The department may establish a registration program and charge a fee for certification or registration applications annual reports, certificates and required documents. Late fees may be charged in addition to renewal fees not more than twice the fee amount.

Previously established under Agriculture Code sec. 12.0175 by S.B. 489, 71st Leg., R.S. with a $150 per participant fee.

H.B. 11, 72nd 1st C.S. added a $500 fee.

H.B. 2446, 73rd Leg., R.S. moved program to Agriculture Code Ch. 18 and increased fees to $2,500 and $5,000.

S.B. 372, 74th Leg., R.S. removed fee amounts and replaced with those determined by the department.
