To record fees for initial application and renewal of license to operate a birthing center. Rates are set by the executive commissioner in such amounts as to defray costs of administration and enforcement.

Civil penalties may also be assessed of not less than $100 and not more than $500 per day per violation (collected under Revenue Object 3717).

Administrative penalties may be assessed not to exceed $1,000 per violation with total for continuing violations not to exceed $5,000 (collected under Revenue Object 3770).

Initial fee at time of application and renewable every two years from date of issue.

Previously deposited to the Birthing Center Licensing Fund Account (0547), abolished August 31, 1995 per § 403.094, Government Code.

Transferred from the Department of Health (501) to Department of State Health Services (537) by H.B. 2292, 78th Leg., R.S.
