Description


Persons convicted of certain offenses under the Penal Code shall pay, in addition to all other costs, court costs for special services as follows:

  • A defendant convicted of a felony -- $185.
  • A defendant convicted of a class A or B misdemeanor -- $147.
  • Conviction of a nonjailable misdemeanor -- $62.

GR Account -- Texas Commission on Law Enforcement receives 3.4418% of total fees collected.

Upon conviction at the same time as other fines and court costs.

Deposited by State Comptroller when received from custodian of municipal or county treasury who is required to remit not later than the last day of the month following each calendar quarter. A municipality or county may retain 10% of collections as a service fee. Continuing education allocations to local law enforcement agencies not later than March 1 of each year.

Previously collected under 3712 Fee From Criminal Offenses (GR Account 0116 and 0581). It was closed and moved under 3704 Court Cost object.

Effective 01/01/2020, S.B. 346, 86th Leg., R.S. increased court costs for felonies from $133 to $185, Class A or B misdemeanor from $83 to $147 and nonjailable misdemeanors from $40 to $62. S.B. 346 changed percentage from 5.0034% to 3.4418%.

S.B. 41, 87th Leg., R.S. repealed Government Code Ch. 102, and index of existing court costs and fees.
