Description


Persons convicted of certain offenses under the Penal Code shall pay, in addition to all other costs, court costs for special services as follows:

  • A defendant convicted of a felony -- $185.
  • A defendant convicted of a class A or B misdemeanor -- $147.
  • Conviction of a nonjailable misdemeanor -- $62.

GR Account 5164 - Youth Diversion receives 2.5956% of total fees collected.

Appropriated only to the Governor's Office, Criminal Justice Division for distribution to local governmental entities for youth diversion services.



Due Date


Upon conviction at the same time as other fines and court costs.

Added by S.B. 1419, 83rd Leg., R.S. Fee dedication was not exempted by funds consolidation bill (H.B. 6), therefore deposited to General Revenue (0001).

GR Account 5164 - Truancy Prevention and Diversion was re-created by S.B. 1296 and H.B. 6, 84th Leg., R.S. This changed deposit of court cost from GR 0001 to GR Account 5164.

Effective 01/01/2020, S.B. 346, 86th Leg., R.S. added percentage of court costs under Local Government Code sec. 133.102. S.B. 346 repealed $2 court cost previously deposited to the account.

Name changed from Truancy Prevention and Diversion by H.B. 3186, 88th Leg., R.S. Effective January 1, 2024.
