Created in 2001 by S.B. 7 and H.B. 3088, 77th Leg., R.S. in TEX. LOC. GOV'T CODE ANN. sec.133.102.  For persons convicted of certain offenses under the Penal Code to pay in addition to all other costs, court costs for special services as follows:
  • A defendant convicted of a felony -- $133.
  • A defendant convicted of a class A or B misdemeanor -- $83.
  • Conviction of a nonjailable misdemeanor -- $40.

GR Account -- Fair Defense receives 8.0143% of total fees collected. Due date was upon conviction at the same time as other fines and court costs.  Remitted to Comptroller -- State Fiscal, Agency 902 by the court officer.  Deposited by Comptroller when received from custodian of municipal or county treasury who is required to remit not later than the last day of the month following each calendar quarter. A municipality or county may retain 10% of collections as a service fee. Administered by the Office of Court Administration, Agency 212. Amended by S.B. 1180, 78th Leg., R.S. Amended by H.B. 442, 82nd Leg., R.S. The object closed and replaced with 3704 Court Costs (GR Account 5073) effective 9/1/2012.
