Revenue Object 3175 – Professional Fees – Asbestos Removal

A person may not engage in removing asbestos, encapsulating asbestos, enclosing asbestos or loading or unloading asbestos from a public building unless licensed. Fees are set by the Board sufficient to generate the amount of revenue necessary to administer the Act as follows:

Air monitoring technician	NTE  100.00

Civil penalties levied for violations cannot exceed $10,000 a day for each violation. Administrative penalties may not exceed $10,000 a day for each violation.

Licenses expire one year from date of issue.

The Department may charge a reasonable fee for asbestos analysis and for the review and approval of plans affecting the control and abatement of asbestos or asbestos-containing material. (TAC 295.21, Texas Register, March 18, 1988). Not refundable.
