Description
A person may not operate a tanning facility without a current and valid permit issued by the Department. The Department by rule may adopt a system under which permits expire on various dates during the year and allows renewal fees to be prorated on a monthly basis to reflect the actual number of months the permit is valid. The Board shall set fees in amounts that allow recovery of not less than 50% of costs for reviewing and acting on applications, modifying or renewing a license, inspecting a licensed facility and implementation and enforcement. Administrative penalties not to exceed $25,000 per violation may also be levied (collected under Revenue Object 3770).
