Description

Texas Commission of Licensing and Regulation by rule may impose fees on dealers, distributors, suppliers and wholesalers for testing, inspection or performance of other services provided as necessary for administering Occupations Code Ch. 2310. Fee to be collected on a periodic basis determined by commissioner from each dealer without regard to whether the motor fuel is regulated under Ch. 2310.

S.B. 2119, 86th Leg., R.S., repealed the fee under Agriculture Code 17.104, it remained in effect until transfer of the fuel program from Department of Agriculture to Department of Licensing and Registration Sept. 1, 2020 per SEC. 11 of S.B. 2119. After that, it was administered by Department of Licensing and Registration per Occupations Code 2310.204.

S.B. 246, 88th Leg., R.S. repealed sec. 2310.204(d) requiring fees be used only for administering and enforcing Ch. 2310.
