Description

The commission shall assess and collect annual fees from all holders of a certificate, permit or license issued by the commission. Fees should be set to cover the costs of administration and the commission shall review fees to ensure they are allocated fairly among license holders. In assessing a fee the commission may not overly penalize any segment of the alcoholic beverage industry or impose an undue hardship on small businesses.

The commission is required to transfer $250,000 per year to the Department of Agriculture to implement the Texas Wine Marketing Assistance program. To cover this transfer, the commission is authorized to impose a surcharge on licenses and permits issued or renewed each fiscal year. The surcharge shall be equal to the amount transferred, divided by the number of licenses and permits estimated to be issued during that year.
