Description
Penalties for the unauthorized discharge of oil:
- Person responsible the discharge is subject to a civil penalty between $250 and $25,000 per day or up to $1,000 per barrel of discharged oil.
- Person in charge of a vessel or terminal facility from which an unauthorized discharge emanates, who knows of the discharge and fails to give immediate notification to the Land Commissioner is subject to a civil penalty between $500 and $250,000 for an individual or $500,000 for a corporation.
- Person responsible for the discharge who fails to abate, contain and remove pollution pursuant to applicable Federal and State requirements is liable for a civil penalty up to $25,000 per day or not more than three times the costs incurred by Coastal Protection Account as a result of the discharge.
A person who violates any provision, rule or order issued under Subchapter C, D or E shall be subject to a civil penalty between $100 and $10,000 per violation per day, not to exceed $125,000. The Land Commissioner may assess administrative penalties for violations and in amounts established in § 40.251.
