Created September 1, 1991 by S.B. 404, 72nd Leg., R.S. in TEX. HEALTH & SAFETY CODE ANN. § 382.0145 for a clean fuel incentive surcharge of 20 cents per MMBTU on fuel oil used between April 15 and Oct. 15 each year in industrial or utility boiler capable of using natural gas, located in an area with a population of 350,000 or more that has not met federal ambient air quality standards for ozone. Inactivated September 1, 2004 due to non-use.
