Created in 1985 by S.B. 577, 69th Leg., R.S. under TEX. PARKS & WILD. CODE ANN. § 88.0081. A permit is required for a person who takes, possesses or transports for commercial sale or hires or pays another to perform these activities involving an endangered, threatened or protected plant from private land. The fee for the permit is set by Parks & Wildlife Department. In addition each plant taken must have a tag attached. The fee for each tag is $1. Inactivated in 2008 for non-utilization.
