Description

(1) Clerk of each district, statutory county, county court at law, justice and municipal court shall collect $25 fee from person convicted of felony or misdemeanor, ordered to pay a fine, court costs, or restitution and seeks to pay over a period of time rather than immediately. Fifty percent of the fees are remitted to the Comptroller and the remaining 50% deposited to general fund of the county or municipality. 100% is due to the Comptroller if the Office of Court Administration determines the municipality or county is not in compliance during an audit under Local Government Code, sec. 133.059.

(2) If a court requires the defendant to make restitution in specified installment payments the court may require a one-time fee of $12 (art. 42.037(g)(1)).
