Description

In addition to each fee collected under Section 51.317 (b) (1) and 101.061 (6), district clerk shall collect a $40 filing fee on each suit filed to be used for court-related purposes for support of the judiciary.

The fees collected under sec. 133.151 are divided between two revenue objects. Of the $45 filing fee for divorce and family law cases and the $50 filing fee for other cases, $40 from each of those fees is deposited under this revenue object to the Judicial Fund. The remaining amounts of these filing fees are deposited under revenue object 3711 - Judicial Fees - Basic Civil Legal Services for Indigents to the Basic Civil Legal Services subaccount in the Judicial Fund.

S.B. 1969, 81st Leg., R.S. repealed 101.061(5)(B) and amended 101.0615 to reflect correct fees.

S.B. 41, 87th Leg., R.S. abolished the $45 filing fee for divorce and family law cases and the $50 filing fee for other cases under 133.151 and added the $137 state civil fee. This fee is now collected under 3711 - Judicial Fees - Judiciary Support. S.B. 41 repealed Government Code Ch. 101, and index of existing court costs and fees.
