GR Account 0345 – Telecommunications Infrastructure

Created September 1, 1995 by H.B. 2128, H.B. 3050, 74th Leg., R.S. in Utilities Code §§ 57.043, 57.0485 to receive annual assessment from each telecommunications utility and commercial mobile service provider at a rate of 1.25% of the taxable telecommunication receipts of each telecommunications utility and commercial mobile service provider. Total deposited to the fund excluding interest and loan repayments up to $1.75 billion. If Comptroller determined no later than August 31 of each year that $1.5 billion or more, excluding interest and loan re-payments, had been deposited, Comptroller imposed the next fiscal year assessment at a rate estimated to result in deposit of not more than $1.75 billion. Assessment not collected during a fiscal year if Comptroller determined that the total collected during that fiscal year and the preceding fiscal years was $1.74 billion or more. Fifty percent of amounts collected deposited to public schools accounts within the fund and the remainder to the credit of the qualifying entities account within the fund. Each account retained its own interest. Amended by S.B. 249, 75th Leg., R.S. Re-created as a GR account by H.B. 3088, 77th Leg., R.S. effective 8-27-01. Board appropriations for 03/04 vetoed by the Governor and closeout duties transferred to the Texas Workforce Commission. Amended by H.B. 3459, 78th Leg., R.S. Effective 9-1-05, S.B. 1863, 79th Leg., R.S. account repealed and allocation amended to require the assessment to be deposited to General Revenue Fund (No. 0001).
