Description

Filing fees collected by state and local courts for funding statewide electronic filing technology projects for courts.

Two fees are charged under Local Government Code sec. 133.151 for filing the following in district court, statutory county court, statutory probate court, or county court:

  1. $137 for filing any civil, probate, guardianship, or mental health case, and
  2. $45 on any other action.

Section 133.151 also includes a $21 fee for filing a civil case and any other action in a justice court.

Of these fees, GR Account 5157 – Statewide Electronic Filing System receives: receives:

  • 21.8978% of the $137 fee,
  • 66.6667% of the $45 fee, and
  • 47.6191% of the $21 fee.

$30 filing fee collected by the clerk of the supreme court, a court of appeals, a district court, a county court, a statutory county court, or a statutory probate court for any civil action, appeal, counterclaim, cross-action, intervention, interpleader, or third-party action requiring a filing fee (51.851).

GR Account 5157 receives the portion of local filing fees, dedicated to county alternative dispute resolution programs, from counties that do not have such a program.

All fees are remitted from the courts to the comptroller.

Filing fee collected by the clerk of the supreme court and others was increased from $20 to $30 by S.B. 1139, 84th Leg., R.S.

H.B. 41, 87th Leg., R.S. repealed the $10 filing fee collected by the clerk of a justice court.
