Description


Fines from municipal and county enforcement related to commercial motor vehicle safety standards violations may be retained by a municipality in an amount up to 110% of actual expenses for enforcement during the preceding year, as determined by the Comptroller after review of the municipal audit. Fines that exceed this limit are sent to the treasury.

Municipalities retaining fines must file a report with the comptroller detailing the amount of fines collected and actual enforcement expenses. Failure to file the report requires the municipality to send to the comptroller an amount equal to the amount retained.
