For each wastewater discharge permit, a maximum of $150,000 water quality fee. Beginning September 1, 2009, the initial maximum fee was set at $100,000. On September 1 of each subsequent year, the commission shall adjust the maximum fee (up to $150,000) to reflect the percentage change in the Consumer Price Index for all urban customers. In determining amount of a fee, permitting factors such as flow volume, toxic pollutant potential, level of traditional pollutants and heat load may be considered. Also considered are designated uses and segment ranking classification of water affected by discharges from permitted facility, as well as other reasonable costs. The commission shall apportion, assess and recover reasonable costs of water quality management programs.
