Description


A county commissioner's court or governing body of a municipality may establish commercially sexually exploited persons court programs for first time offenders (Ch. 169) and other offenders (Ch. 126). A program may charge an eligible defendant up to $1,000, of which a portion (victim services fee) equal to 10% of the total is remitted to the state.

H.B. 1994, 82nd Leg., R.S. dedicated the state portion of the fee to the Health and Human Services Commission, Agency 529, however the dedication was not exempted in S.B. 1588 (funds consolidation bill) and is deposited to undedicated GR.

S.B. 462, 83rd Leg., R.S. repealed TEX. GOV'T CODE ANN. sec. 103.029 and103.0291 and moved fee to 103.0292.

S.B. 536, 84th Leg., R.S. changed program name and citation from Health and Safety Code Ch. 169A to Government Code Ch.126.

Effective 01/01/2020, S.B. 346, 86th Leg., R.S. repealed 10% state share remitted to General Revenue. Court costs collected under these statutes retained locally.
