Description


Persons convicted of certain offenses under the Penal Code pay in addition to all other costs, court costs for special services as follows:

  • A defendant convicted of a felony -- $185.
  • A defendant convicted of a class A or B misdemeanor -- $147.
  • Conviction of a nonjailable misdemeanor -- $62.

Law Enforcement and Custodial Officer Supplement Retirement Trust Fund (0977) receives 7.2674% of total fees collected.



Due Date


Upon conviction at the same time as other fines and court costs.

Deposited by Comptroller when received from custodian of municipality or county treasury, required to remit not later than last day of the month following each calendar quarter.

Municipality or county may retain 10% as a service fee.

Effective 9-1-13, the deposit fund changed from GR Account -- Operator and Chauffeur's License (No. 0099) to the Law Enforcement and Custodial Officer Supplement Retirement Trust Fund (No. 0977) per S.B. 1664, 82nd Leg., R.S.

Effective 01/01/2020, S.B. 346, 86th Leg., R.S. increased court costs for felonies from $133 to $185, Class A or B misdemeanor from $83 to $147 and nonjailable misdemeanors from $40 to $62. S.B. 346 changed percentage from 11.1426% to 7.2674%.

S.B. 41, 87th Leg., R.S. repealed Government Code Ch. 102, and index of existing court costs and fees.
