Created in 1985 by H.B. 309, 69th Leg., R.S. in TEX. GOV'T CODE ANN. sec.56.001 and TEX. GOV'T CODE ANN. sec.102.021(6) and TEX. LOC. GOV'T CODE ANN. sec.133.102. For persons convicted of certain offenses under the Penal Code to pay in addition to all other costs, court costs for special services as follows:
  • A defendant convicted of a felony -- $133.
  • A defendant convicted of a class A or B misdemeanor -- $83.
  • Conviction of a nonjailable misdemeanor -- $40.

Judicial and Court Personnel Training Fund receives 4.8362% of total fees collected.
Fee due upon conviction at the same time as other fines and costs.  Remitted to Comptroller -- State Fiscal, Agency 902 by the court officer.
Deposited by Comptroller when received from custodian of municipal or county treasury who is required to remit not later than the last day of the month following each calendar quarter.
A municipality or county may retain 10% of collections as a service fee. Administered by the Court of Criminal Appeals, Agency 211. Amended by: S.B. 947, 73rd Leg., R.S.; S.B. 1180, 78th Leg., R.S. Fund 0540 recreated as a GR account by S.B. 1, 82nd Leg., R.S. The object closed and replaced with 3704 Court Costs (GR Account 0540) effective 9/1/2012.
