Description

1) A permit for excess weight vehicles is valid for one year. The fee is a base fee of $90. Fees for excess weight carried by loaded motor vehicle (exceeding registered gross weight) in an amount that will cause the gross registration to be equal to the gross weight of the vehicle, provided such total registration shall not exceed the gross weight allowed for such vehicle.

3) In addition, an administrative fee as set by rule to cover costs is required.

4) Violations punishable by fines of NLT $100 or more than $150; or NLT $300 or more than $500 if vehicle gross weight more than 5,000 pounds and not more than 10,000 pounds; or NLT $500 or more than $1,000 if vehicle gross weight is 10,000 pounds or more over allowable gross weight.

Due Date

1), 2) and 3) At the time permit is issued; At time the vehicle is weighed and the excess weight is determined.

Deposit Funds

  • 1) The base fee of $90 is split, $50 to General Revenue Fund (No. 0001), $40 to State Highway Fund (No. 0006).
    2) Amount to GR 0001 and State Highway Fund 0006 as noted above per H.B. 2093, 80th Leg., R.S.
    3) State Highway Fund (No. 0006)
    4) For fines beginning at $300, an amount equal to 50% of the fine to General Revenue Fund (No. 0001) and 50% to municipal or county treasury unless the offense occurred within 20 miles of an international border, in which event the entire amount deposited in municipal or county treasury for road maintenance.

Notes

If fees are collected by a county other than the county in which the vehicle owner resides, the fee is remitted to the Texas Department of Motor Vehicles, Agency 608.
