Description

(1) With each application or materially amended application for a permit to drill, deepen, plug back or re-enter an oil or gas well, a fee of:

  • $200 if the total depth of the well is 2,000 feet or less;
  • $225 if the total depth of the well is greater than 2,000 feet but less than or equal to 4,000 feet;
  • $250 if the total depth of the well is greater than 4,000 feet but less than or equal to 9,000 feet;
  • $300 if the total depth of the well is greater than 9,000 feet.

(2) In addition, the applicant shall submit a non-refundable fee of $150 when requesting that the Commission expedite the application.

(3) With each application for a fluid injection well permit (any well used to inject fluid or gas into the ground in connection with the exploration or production of oil or gas other than a waste disposal well), a fee of $200.

(4) With each application for a permit to discharge to surface water, a fee of $300.

(5) A non-refundable fee of $200 when a Rule 37 spacing or Rule 38 density exception review is required.

(6) Applicant for designation as operator of an abandoned well shall pay a non-refundable fee of $250.

Previously deposited to the State Well Plugging Fund (0503). Repealed in 1992 by S.B. 1103, 72nd Leg., R.S. and receipts directed to the GR Account 0145 - Oil-field Cleanup.

S.B. 1103, 72nd Leg., R.S. repealed this fee as of August 31, 1999. S.B. 115, 76th Leg., R.S. repealed the repealer, leaving the fee in effect on September 1, 1999.

$300 fee for application for an extension of time to plug a well unless a bond, letter of credit or cash deposit has been filed under § 91.104(b) was amended by H.B. 1317, 77th Leg., R.S.

Rates amended and (5) added by S.B. 310, 77th Leg., R.S.. Per S.B. 310, the $300 fee for application for an extension of time to plug a well under § 91.104(b) was deleted September 1, 2004.

(3) and (4) increased from $100 and $200 respectively by S.B. 308, 77th Leg., R.S.
