Description

The Department may assess an administrative penalty in amounts depending under what chapter the violation occurs. Texas Agriculture Code sec. 12.020 lists each chapter and the corresponding maximum penalty amount. Each day a violation occurs is considered a separate violation.

  • Up to $5,000 for Agriculture Code Chapters 13, 14A, 18, 19, 41, 46, 61, 72, 73, 74, 76, 94, 95, 101, 102, 103, 125, 132, 134, and Subchapters A, B & C of Chapter 71.
  • Up to $10,000 for Agriculture Code Chapter 14.
  • Up to $5,000 for Agriculture Code 91.009, Occupations Code Chapter 1951 and Natural Resources Code Chapter 153.

Hemp production violations under Ch. 122, subchapter I are deposited to GR Account 5178 - State Hemp Program.
