Created in 1989 by S.B. 1223, 71st Leg., R.S. under TEX. HEALTH & SAFETY CODE ANN. ch. 370. Any person, other than a governmental entity, who violates any requirement of this Texas Toxic Chemical Release Reporting Act shall be liable to the Texas Commission on Environmental Quality for a civil penalty in an amount not to exceed $10,000 for each violation. The Commission may assess any civil penalty for which a person is liable by administrative order or may refer an action to assess and collect the penalty to the Attorney General of the State of Texas. Inactivated in 2008 for non-utilization.
