Purpose

Money in the account used to support the activities of the Texas Low-Level Radioactive Waste Disposal Compact Commission. Used for the decontamination, decommissioning, stabilization, reclamation, maintenance, surveillance, control, storage, and disposal of radioactive substances. Money in the account may not be used for normal operating expenses of the commission.

For deposit of certain radioactive materials and devices regulation fees (see revenue object 3589) and low-level radiation waste disposal fees (revenue object 3590).

A $100 million cap is imposed on the sum of this account and certain fees collected by TCEQ deposited to GR Account 5096 - Perpetual Care. Fees collected under §§ 401.052(d) and 401.301(d) are suspended when the cumulative $100 million cap is reached The exception to this cap is for fees on licensed uranium or thorium ore processors. Fees for these entities are only suspended when the amount in GR Account 5158 attributable to those fees reaches $2 million.  If the amount decreases to $1.5 million, the fee is reinstated until the amount reaches $2 million (see description of revenue code 3589).
