Description


The department shall adopt reasonable fees against railroads operating within the state. The total estimated to be collected may not exceed the amount estimated to be necessary to recover the cost of administering the rail safety program (111.101).

A rail company or other entity must reimburse the agency the salvage value of a state-purchased rail warning signal if the signal is dismantled by the rail company (471.005).

Department shall impose a reasonable fee on a railroad company that submits an application to adopt safety standards for high-speed rail systems. Fees set to recover costs incurred by the department (111.103).

H.B. 1657, 73rd Leg., R.S. added warning signal reimbursement.

Warning signal previously under revenue code 3061, however as of fiscal year 2015, TxDOT had not collected any related revenue. Revenue code 3061 was inactivated and the authority moved to this revenue code.

Warning signal reimbursements previously directed  to the Railroad Crossing Warning Signal Fund Account (No. 0331), abolished August 31, 1995 per § 403.094, Government Code.

Duties related to rail safety (111.101) transferred from the Railroad Commission of Texas (455) to TXDOT per H.B. 2702, 79th Leg., R.S.

111.101 recodified by S.B. 1540, 81st Leg., R.S.

High speed rail safety standards added by H.B. 3771, 82nd Leg., R.S.
