Description

The commission is required to adopt, charge and collect application, permit and inspection fees (382.062) and operating permit fees (382.0621). Fees charged by the commission to assure all general industrial construction meets air pollution standards as established by the federal EPA and Texas Clean Air Act. Board may adopt rules relating to charging and collecting fees for permits, special permits, permit revision or amendment, exemption from construction permits, including schedules of fees to be charged. The commission may add a surcharge for expedited application processing for applications submitted under Health and Safety Code Ch. 382.

Application, permit and inspection fees are to recover at least 50% of actual annual expenditures in administering the Act. and must be between $25 and $75,000. First collected January 1, 1983.

In addition to other operating fees, the commission may charge a fee for the emission of greenhouse gases.
