Description
To record:
- Fees collected for searching, preparing and issuing copies and certified copies of birth, death, fetal death, marriage, divorce, annulment and other records and for filing records, amendments and affidavits. The executive commissioner by rule may prescribe a schedule of fees for these services, however the aggregate amounts of fees may not exceed cost of administering the vital statistics system. These fees are deposited to GR Account - Vital Statistics (0019).
- $2 fee collected by the department for issuing a certified copy of a birth certificate or a wallet-sized birth certificate and for searching for a birth certificate. These fees are deposited to GR Account - Vital Statistics (0019).
- Fees collected and remitted by local registrars for issuing certified copies of birth certificates. Local registrars shall collect the same fees as the department and shall remit $1.80 to the comptroller for deposit to the General Revenue Fund (0001).
- Fees charged for processing a search of paternity registry and furnishing a certificate of results.
- Fees collected for heirloom birth certificates set by the executive commissioner by rule not exceed $50. Of this fee, 50% is deposited to the General Revenue Fund (0001) and 50% to GR Account - Childhood Immunization (5125).
- $50 fee collected for heirloom wedding anniversary certificates deposited to GR Account - Childhood Immunization (5125).
Certificate fee waivers for certain for admission to school, veterans, foster or homeless youth, victims and children of victims of family violence, and other instances.

A family protection fee issued under Government Code § 51.961 of $30 was to be retained 50% by county and 50% remitted to state for deposit to GR Account-Child Neglect and Prevention, 5085. This fee was declared unconstitutional by Attorney General Opinion GA 0387 in 2006.
